DREAMTIME PARTI POODLES
PUPPY CONTRACT
***If you are purchasing a dog that is over 6 months of age this warranty will change from 12 months to 90 days from purchase.
*Your puppy has received his first set of shots and been dewormed on a regular schedule, however, it takes a series of shots to provide full immunity and as such seller strongly recommends that you keep your puppy at home and away from other dogs (especially unvaccinated ones) until 10 days after the full series of vaccinations are complete. When taking your puppy to the vet for his initial exam and subsequent shots seller also strongly stresses that it is important to not let your puppy’s feet touch any surface that has not been cleaned with bleach or a strong parvicide. A good suggestion is to take a couple of towels with you from home and place them on the exam table before setting your puppy down, then washing the towels with hot water & bleach once you get home. There is also a risk of your puppy contracting an illness if he is let out in your yard before vaccinations are complete, seller has already started training your puppy to use potty pads and that is a good way to continue at least until vaccinations are complete. Not following these guidelines can expose your puppy to serious illnesses that he/she has no immunity to. Common puppy problems that occur that are either non-life threatening, or curable are not warranted by seller.
Buyer please initial and date here __________________
*Your puppy has been examined by a licensed veterinarian and pronounced healthy. Please take your puppy to your personal vet for an initial exam with 48 hrs (business) of receipt of puppy. Seller guarantees against any life-threatening, incurable congenital defects only. Seller is not responsible for any veterinarian fees associated with that exam and buyer will be responsible for return shipping. If you don’t have the puppy examined within 48 business hrs. the warranty will be considered null and void and no refund will be given even if the puppy is returned. If problems are found and you don’t notify seller within that initial 48 business hrs. the warranty will be considered null and void and no refund will be given. A report from your vet signed and dated by him on his business letterhead, detailing his findings, must be obtained and provided to me, and a second vet of my choice must be allowed (at my expense) to examine the puppy again, and if both veterinarians agree that there is an incurable, life-threatening genetic defect which existed at the time of receipt of the puppy, and providing that the puppy has been properly cared for in the purchaser’s possession, seller then guarantees to refund the purchase price of the puppy only, minus any shipping charges and any nonrefundable deposit. Buyer will be responsible for all vet fees and return shipping expenses. A copy of this contract must be presented upon return of a puppy. All registration papers, immunization and health records, microchip information must accompany the return of the puppy. Should death occur within this initial 48 hr. period, seller must be notified immediately and an autopsy must be performed at a Diagnostic Laboratory Clinic, at the purchaser’s expense, to determine the cause of death, and a written report of the findings must be provided to me. If the death was caused by a congenital genetic defect only, a refund will be provided, minus any deposit, shipping or veterinary expenses. Buyer please initial and date here ______________
Following the initial 48 hr. period, if within the first 12 months of the puppy’s life it is found to have an incurable, life-threatening genetic illness, the buyer has the option of returning the dog to me in exchange for a replacement puppy of the same or lesser monetary value, unless buyer agrees to pay the difference in cost for a more valuable puppy. All conditions from above must be met and buyer is responsible for all veterinary and shipping costs, both of the return and the replacement puppy. Seller will have 12 months to replace the puppy if a suitable one is not available at that time. No refund will be given if a female has been bred. Buyer please initial and date here ______________
Other than the above guarantee, DreamTime Parti Poodles assumes no monetary responsibility for puppies once they leave my premises. Any illness, trauma, stress or stress-related consequences incurred due to mishandling during delivery or transportation, or in the process of the puppy adjusting to a new home, new routine and new food are not warranted by me. Buyer please initial and date here _____________
Common puppy problems that may occur due to the stress of adjusting to a new environment or mishandling by the new owner are not warranted under this limited health guarantee, including, but not limited to, coccidia, giardia, internal parasites, parvo, distemper, hypoglycemia. Buyer please initial and date here ________________
This guarantee will be considered null and void if health exam is performed at any Banfield Pet Hospital/Veterinary Clinic or it’s associates. Buyer please initial and date here _________________
*The only difference between the three different sizes of poodles is just that…size, and the difference of half an inch can determine whether you have a toy poodle or a miniature poodle. Genetics can be such that you can get toy and miniature puppies from the same litter, and as such seller can make no guarantee as to the final adult size of your puppy. Buyer please initial and date here ________________
-Adult color as well is impossible to guarantee because many poodles carry a fading gene, which causes the puppy’s color to fade as he/she gets older. Buyer please initial and date here __________________
-Temperament is another factor that is impossible to guarantee. Much of a puppy’s temperament develops as the puppy grows and interacts with you and your family and his environment, and as such I cannot make any guarantees concerning temperament. Buyer please initial here and date _________________
-Seller makes no guarantees as to the reproductive health or breeding potential of the puppy. This includes, but is not limited to, fertility at adulthood, descent of testicles, any difficulties whelping puppies, any injury incurred during breeding or whelping, or death of the bitch or pups during whelping. Buyer please initial and date here _________________
Occasionally a puppy is born with a defect and still needs to be placed in an appropriate home. Seller will disclose any known defects prior to finalizing a sale and buyer will accept all responsibility for care concerning that defect.
Defect - ______________________________________ Buyer please initial and date here _______________
*My goal in breeding these dogs is that each puppy be placed in a permanent, loving home and to avoid the situation where the puppy is bounced from home to home, abused, neglected or ends up in a shelter. As such I am committed for the lifetime of the dog to making sure that it is well cared for and REQUIRE that if, for any reason, you find that you cannot keep the dog, that it be returned to me. Under NO circumstances may this dog be resold, given away or placed with a rescue agency or a shelter, it is to be returned to me! Ownership will be legally turned back over to me along with all registration papers, microchip, vaccination and health information. Once seller has found an appropriate home for the dog half of what it is sold for will be returned to you, minus half of what it cost to ship the pup back to me. Buyer please initial and date here ___________________
*If your puppy is being sold with a spay/neuter contract he/she should be neutered or spayed between 6 & 12 months of age. AKC registration papers will be retained by seller until proof is provided that the surgery has been performed, and they will then be posted to you within 10 business days of receiving the notice. A signed statement by the veterinarian or copy of the receipt will be sufficient proof. Buyer please initial and date here ___________________
*Puppy will have already received one or two sets of vaccines prior to transfer. If buyer allows a vet to redo those vaccines then the health guarantee will be considered null and void. You will receive information concerning vaccinations and what is due for your puppy. To redo any vaccinations is putting a great deal of stress on the puppy’s whole system and can cause many serious if not deadly consequences. Buyer please initial and date here ______________
***If you are purchasing a dog that is over 6 months of age this warranty will change from 12 months to 90 days from purchase.
This guarantee is nontransferable and applies only to the original buyer.
IN THE EVENT THAT THIS DOG IS MISTREATED, NEGLECTED OR ABUSED IN ANY WAY, KEPT OUTSIDE IN EXTREME HEAT OR EXTREME COLD CONDITIONS OR KEPT ON WIRE FLOORING AT ANY TIME DURING IT’S LIFE, OR BRED WHEN SOLD AS A PET ONLY, SELLER WILL HAVE THE RIGHT TO IMMEDIATELY REPOSSESS THE DOG, ALONG WITH ALL AKC PAPERS AND HEALTH RECORDS. BUYER WILL BE RESPONSIBLE FOR ANY AND ALL LEGAL FEES AND COURT COSTS INCURRED BY THE SELLER IF LEGAL ACTION IS REQUIRED TO REPOSSESS THE DOG.
This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of New Mexico. If either party brings against the other party any proceeding arising out of this Agreement, that party must bring that proceeding only in the First Judicial District Court, Sandoval County, New Mexico.

Purchase Price $ _____________Non-Refundable Holding Fee $ _______________ (Included in the purchase price, to hold puppy until it is ready to be adopted.)
Puppy is to be paid in full by the time he/she is 8 wks old if being transported. If the buyer will be picking up in person, then the final payment is to be made in cash at that time. Any pup over the age of 9 weeks or adult dog must be entirely paid for at the time of purchase and 2 weeks prior to transferring possession. Buyer please date and initial here_______________
***Should buyer change their mind about adopting the puppy, the Holding Fee is non-refundable. This fee may be transferred to a different puppy if one is available. Should the puppy die or turn out to have a physical defect that would prevent adoption prior to being transferred to the new owner, the holding fee will either be refunded or may be transferred to a different puppy. If the buyer changes their mind and wants to transfer the fee to a different puppy and a suitable one is currently not available they will be given 12 months to transfer the fee to a different pup.
